Acceptable Use Policy

OTR404 exists to make AI use private. Privacy is for individuals exercising their lawful rights — it is not a license to harm others. This Acceptable Use Policy ("AUP") sets out what you may not do with the Service. It applies to everyone who uses OTR404, on every plan, including the Ephemeral VPC tier. By using the Service, you agree to this AUP. We may update it as new abuse patterns emerge; the current version always lives at this page.

1. Prohibited Content and Activity

You may not use the Service, directly or indirectly, to generate, distribute, facilitate, or attempt any of the following:

1.1 Sexual exploitation of minors

  • Any content that sexually exploits, depicts, or endangers minors, including child sexual abuse material (CSAM) and any sexualized depiction of a minor, real or generated. We report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement.

1.2 Violence, self-harm, and weapons

  • Threats of violence, incitement to violence, or content glorifying mass violence or terrorism
  • Detailed operational guidance for the creation or use of biological, chemical, radiological, or nuclear weapons
  • Detailed instructions for building unlawful firearms, explosives, or improvised weapons
  • Content promoting or facilitating suicide, self-harm, or eating disorders

1.3 Fraud, deception, and impersonation

  • Phishing, smishing, scam, or social-engineering content
  • Generating fake identification, financial instruments, or government documents
  • Impersonating a real person, organization, or government entity in a way intended to deceive
  • Election interference, including generating false statements attributed to real political figures, voter-suppression content, or coordinated inauthentic behavior
  • Synthetic intimate imagery of an identifiable person without that person's consent ("non-consensual intimate imagery" or "deepfake pornography")

1.4 Malware, exploits, and unauthorized access

  • Creating, distributing, or improving malware, ransomware, spyware, keyloggers, rootkits, or stalkerware
  • Developing exploits for vulnerabilities in production systems you do not own or have authorization to test
  • Attacks against critical infrastructure (power, water, healthcare, financial market systems)
  • Credential stuffing, brute-force attacks, or any attempt to gain unauthorized access to accounts or systems

1.5 Harassment, hate, and privacy violations

  • Targeted harassment, threats, or stalking of an individual or group
  • Content that incites discrimination or violence against people based on race, ethnicity, national origin, religion, disability, gender, sexual orientation, or gender identity
  • Doxing — publishing or compiling private personal information (home address, private contact details, government IDs, financial accounts) without consent

1.6 Illegal goods and services

  • Sale or trafficking of controlled substances, illicit drugs, prescription drugs without authorization, firearms in violation of applicable law, or counterfeit goods
  • Human trafficking, forced labor, or commercial sexual services
  • Activities that violate sanctions or export-control laws of the United States, the United Kingdom, the European Union, or any other applicable jurisdiction

1.7 Intellectual property and confidentiality violations

  • Reproducing copyrighted works, trade secrets, or proprietary code in a manner that infringes third-party rights
  • Misappropriating confidential information you do not have authorization to process

1.8 Spam and platform abuse

  • Generating bulk unsolicited messages (email, SMS, or chat spam)
  • Operating bot networks, fake-review farms, or coordinated-inauthentic-content campaigns
  • Reselling raw model output as a competing inference API without our written authorization

2. Upstream Provider Policies Still Apply

When you use the Service to access frontier models from third-party providers (currently OpenAI, Anthropic, and Google Gemini), those providers' usage policies apply to your requests. We pass requests to those providers under zero-retention agreements, but the providers still apply their own safety classifiers in real time. Repeated violations of an upstream provider's policies may cause us to suspend your access to that provider's models or, in serious cases, to the Service overall.

For self-hosted open-source models and the Ephemeral VPC tier, OTR404 enforces this AUP directly and may apply additional safety measures at the inference layer. These measures do not store the content of your conversations; they evaluate requests in real time and do not persist beyond the request itself.

3. Age Restriction

The Service is for adults. You must be at least 18 years old to create an account or use the Service. If we learn that an account belongs to a person under 18, we will terminate it.

4. Reporting Abuse

If you believe someone is using the Service in violation of this AUP, please email abuse@otr404.com. Reports involving apparent child sexual abuse material should also be made directly to the CyberTipline at report.cybertip.org.

Law-enforcement requests should be directed to legal@otr404.com. We respond to lawful requests within applicable legal frameworks. Because we do not retain conversation content, our ability to respond to requests for user content is inherently limited; we can confirm account existence, billing records, and account metadata where required by law.

5. Enforcement

We may, at our sole discretion and without prior notice:

  • Refuse, limit, or rate-limit specific requests
  • Suspend or terminate any account that violates this AUP
  • Forfeit any unused credits, prepaid balances, or subscription periods on accounts terminated for AUP violations
  • Report suspected illegal activity to law enforcement and cooperate with lawful investigations

Enforcement decisions are not subject to refund. If you believe enforcement against your account was made in error, contact appeals@otr404.com.

6. Changes to This Policy

We may revise this AUP from time to time as new abuse patterns emerge or as applicable law changes. The most current version is always at this page with an updated "Last Updated" date. Continued use of the Service after a revision constitutes acceptance of the revised policy.

7. Relationship to Other Terms

This AUP is part of, and incorporated by reference into, the OTR404 Terms of Service and Privacy Policy. In the event of any conflict between this AUP and the Terms of Service, the more restrictive provision applies to the conduct in question.
